Terms and Conditions

1. Legal Identity

This business operates in compliance with applicable regulations of the Ministry of Commerce and Industry and relevant Kuwaiti commercial and consumer laws.
2. Eligibility
By using this website, you confirm:
- You are legally capable of entering binding contracts.
- You are at least 21 years old or purchasing under lawful supervision.
3. Nature of Products
- Only physical IT hardware products are sold via this website.
- Services, subscriptions, licensing, and B2B contracts require direct engagement.
- All product descriptions are provided to the best of our knowledge; typographical errors may occur.
We reserve the right to:
- Correct pricing errors.
- Cancel orders due to stock or pricing discrepancies.
4. Order Acceptance & Contract Formation
An order constitutes an offer to purchase.
A binding contract is formed only upon:
- Payment confirmation; or
- COD confirmation and dispatch notification.
We reserve the right to refuse or cancel any order without prior notice if:
- Fraud is suspected
- Pricing error exists
- Product is unavailable
- Regulatory compliance requires refusal
5. Pricing & Payment
- All prices are in Kuwaiti Dinar (KWD).
- No VAT is currently imposed in Kuwait.
- Delivery fees are calculated at checkout.
- Payment methods: COD, Bank Link Payment, Card and KNET.
Failure to complete payment voids the order.
6. Delivery & Risk Transfer
- Delivery timeframe: 1–3 business days (Kuwait only).
- Pickup available after 1 business day.
- Delivery handled in-house.
- Risk transfers upon physical delivery confirmation.
Delays caused by incorrect address information are customer responsibility.
7. Inspection & Acceptance
Customers must inspect products upon receipt.
Failure to notify defects within 48 hours constitutes deemed acceptance (excluding hidden manufacturing defects).
8. Warranty & Manufacturer Responsibility
Products are covered under manufacturer warranty where applicable.
Al Shamali Computers:
- Is not the manufacturer.
- Does not provide extended warranty unless explicitly stated.
- Acts only as facilitator for warranty coordination.
Warranty decisions remain subject to manufacturer approval.
9. DOA (Dead on Arrival)
- Must be reported within 48 hours.
- Subject to technical verification.
- Replacement provided only after validation.
10. Technical Advice & Compatibility Disclaimer
All technical recommendations are provided without guarantee of suitability.
Customers are solely responsible for:
- Verifying compatibility
- Confirming technical specifications
- Ensuring integration feasibility
We shall not be liable for incompatibility where specifications were clearly disclosed.
11. Limitation of Liability (Strengthened)
To the maximum extent permitted under Kuwaiti law:
- We shall not be liable for indirect, incidental, punitive, or consequential damages.
- We are not liable for:
- Business interruption
- Data loss
- Loss of profits
- Loss of goodwill
- Maximum aggregate liability shall not exceed the value of the purchased product.
Nothing in this clause excludes liability where exclusion is prohibited under Kuwaiti law.
11A. Professional Use Disclaimer
Products sold may be integrated into enterprise environments.
Al Shamali Computers shall not be liable for:
- Network downtime
- Cybersecurity breaches
- Data corruption
- System incompatibility within enterprise infrastructure
- Loss of business continuity
It is the sole responsibility of the purchasing entity to:
- Conduct technical validation
- Perform risk assessment
- Maintain data backups
- Ensure cybersecurity compliance
12. Indemnification
You agree to indemnify and hold harmless Al Shamali Computers from claims arising out of:
- Misuse of products
- Unauthorized modifications
- Commercial misuse beyond specifications
13. Force Majeure
We are not liable for delay or failure due to:
- Government action
- Import restrictions
- Supply chain disruption
- Natural disasters
- Public emergencies
- Technical system failures beyond reasonable control
14. Governing Law & Arbitration (Strengthened)
This agreement shall be governed exclusively by the laws of the State of Kuwait.
Any dispute, controversy, or claim arising from or relating to this agreement shall:
- First be resolved amicably within 30 days.
- If unresolved, be referred to binding arbitration in Kuwait.
- Arbitration shall be conducted in Arabic or English.
- The arbitration decision shall be final and enforceable.
Nothing prevents either party from seeking urgent injunctive relief before Kuwaiti courts.
15. Amendments
We may amend these Terms at any time. Continued use constitutes acceptance.
16. B2B Transactions & Corporate Orders
For transactions conducted with business entities:
- If a separate written agreement exists between Al Shamali Computers and a corporate client, that agreement shall prevail over these website Terms.
- Corporate purchases are presumed to be for professional or commercial use.
- Consumer protection provisions applicable to individuals may not apply to B2B transactions where legally permissible.
- Bulk, project-based, or tender-based sales are subject to separate contractual documentation.
- Risk assessment, technical suitability, and deployment planning remain the sole responsibility of the purchasing entity.
